BARTENDERSNOW BETA PROGRAM TERMS

Welcome to the bartendersNow Beta Program (the "Program")!  Thank you for your interest in helping us test and improve our platform.  These Beta Program Terms (the "Beta Terms") govern your participation in the Program.  By participating in the Program, you agree to be bound by these Beta Terms, as well as our general Terms of Service (the "General Terms"), which are incorporated herein by reference.  In the event of a conflict between these Beta Terms and the General Terms, these Beta Terms will govern with respect to your participation in the Program.

1. PURPOSE OF THE BETA PROGRAM

The purpose of the Program is to allow select users to test new features and functionalities of the bartendersNow platform (the "Beta Platform") before they are released to the general public.  Your participation will help us identify bugs, gather feedback, and improve the Beta Platform.

2. ELIGIBILITY

Participation in the Program is by invitation only.  bartendersNow reserves the right to select participants in its sole discretion.  We may consider factors such as your usage of the platform, your feedback history, and other criteria we deem relevant.

3. CONFIDENTIALITY

You agree to keep all information related to the Beta Platform, including its features, functionalities, and any feedback you provide, strictly confidential.  You will not disclose this information to any third party without the prior written consent of bartendersNow.

4. FEEDBACK

You agree to provide regular and constructive feedback on your experience with the Beta Platform.  This includes reporting any bugs, errors, or usability issues you encounter, as well as providing suggestions for improvement.  You may provide feedback through the designated channels provided by bartendersNow.

5. DISCLAIMER OF WARRANTIES

THE BETA PLATFORM IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.  BARTENDERSNOW DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, AND NON-INFRINGEMENT.  WE DO NOT WARRANT THAT THE BETA PLATFORM WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED.

6. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, BARTENDERSNOW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE PROGRAM OR YOUR USE OF THE BETA PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.  OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE BETA TERMS OR YOUR PARTICIPATION IN THE PROGRAM WILL NOT EXCEED $0.01 USD.

7. TERMINATION

bartendersNow may terminate your participation in the Program at any time, with or without cause.  You may also terminate your participation in the Program by notifying us in writing.

8. CHANGES TO BETA PROGRAM

bartendersNow reserves the right to modify or terminate the Program, or these Beta Terms, at any time, with or without notice.

9. GOVERNING LAW

These Beta Terms will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

10. ENTIRE AGREEMENT

These Beta Terms, together with the General Terms, constitute the entire agreement between you and bartendersNow regarding your participation in the Program.
