bartendersNow - terms of service

Young Event Group LLC dba bartendersNow ("bartendersNow," "we," "us," or "our") provides a technology platform (the "Platform") that connects event hosts ("Hosts") with independent mobile bartenders ("Bartenders") for the purpose of facilitating private events. bartendersNow does not provide bartending services directly. Our Platform is accessible through www.bartendersnow.events and associated web apps.

2. ACCEPTANCE OF TERMS

By accessing or using the Platform, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Platform. These Terms constitute a legally binding agreement between you and bartendersNow.

3. USE OF PLATFORM

Legal Compliance: You represent and warrant that you are of legal drinking age in the jurisdiction where the event will be held. You acknowledge that the purchase, possession, consumption, and service of alcohol are subject to various local, state, and federal laws and regulations. You are solely responsible for ensuring compliance with all such applicable laws and regulations at any event you host or participate in. This includes, but is not limited to, verifying the legal drinking age of all attendees and ensuring responsible alcohol service. bartendersNow does not assume any responsibility for your compliance with these laws and regulations.
Platform Purpose: You agree to use the Platform only for lawful purposes and in a manner that does not violate these Terms or any applicable laws or regulations. You agree not to use the Platform: (a) To facilitate the illegal sale or distribution of alcohol; (b) To provide alcohol to minors; (c) To facilitate or participate in any activity that violates any local, state, or federal laws or regulations; (d) For any purpose other than connecting Hosts and Bartenders for private events.
Relationship of Parties: bartendersNow acts solely as a platform provider. We do not employ Bartenders, nor do we control their actions. Bartenders are independent contractors, and Hosts are responsible for selecting and engaging Bartenders. We are not responsible for the acts or omissions of either Hosts or Bartenders, including but not limited to their conduct at events, their adherence to responsible alcohol service practices, or their compliance with applicable laws and regulations. Any agreement for services is solely between the Host and the Bartender. We do not guarantee the availability or quality of Bartenders' services. We do not vet or verify the qualifications or licenses of Bartenders. Hosts are responsible for conducting their own due diligence regarding Bartenders.
Alcohol Responsibility: You understand and agree that bartendersNow is not responsible for the actions of Hosts or Bartenders, including but not limited to their compliance with alcohol-related laws and regulations. This includes, but is not limited to, verifying the age of attendees, preventing overservice, and refusing service to visibly intoxicated persons. bartendersNow simply provides a platform to connect these parties. You acknowledge that the consumption of alcohol carries inherent risks, and you assume full responsibility for any consequences related to alcohol consumption at events facilitated through the Platform. Hosts are advised to exercise responsible judgment in the provision of alcohol to their guests. Bartenders are responsible for refusing service to visibly intoxicated persons. You agree to release and hold harmless bartendersNow from any and all claims, liabilities, damages, or losses arising out of or in connection with the service or consumption of alcohol at any event facilitated through the Platform.
User Content: You are solely responsible for any content you post or transmit through the Platform. You agree not to post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable. You represent and warrant that you have all necessary rights to post any content you submit to the platform.
Account Sharing and Falsification: You agree not to share your account credentials with any other person. You are solely responsible for all activity that occurs under your account. You agree not to provide false or misleading information when creating or using your account. Providing false information may result in the immediate termination of your account.

4. COMMUNICATIONS

By using our Platform, you agree to receive communications from bartendersNow, its affiliates, and partners, which may include promotional and marketing materials. You may opt-out of receiving marketing communications at any time by following the instructions provided in the communication or by contacting us at help@bartendersnow.events. By creating an account, you agree to receive SMS messages from bartendersNow regarding updates, promotions, and important information related to your event bookings. Standard message and data rates may apply. You may opt-out of SMS messages by replying "STOP."

5. PROPRIETARY INFORMATION

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access to your account.

You agree to pay for any services purchased through the Platform according to the applicable pricing and payment terms.

8. PRIVACY POLICY

Our Privacy Policy, available at www.bartendersnow.events/privacy-policy, governs the collection, use, and disclosure of your personal information. By using the Platform, you agree to the terms of our Privacy Policy. We collect information such as name, address, email, phone number, date of birth, and other relevant information for verification, marketing, and operational purposes. We will not share your information with third parties except as described in our Privacy Policy.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, BARTENDERSNOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WE DISCLAIM ALL LIABILITY FOR THE ACTIONS OF HOSTS AND BARTENDERS, INCLUDING BUT NOT LIMITED TO THEIR COMPLIANCE WITH ALCOHOL-RELATED LAWS AND REGULATIONS, THEIR CONDUCT AT EVENTS, AND ANY INJURIES OR DAMAGES ARISING THEREFROM.

10. INDEMNIFICATION

You agree to indemnify and hold harmless bartendersNow, its affiliates, officers, directors, employees, and agents from any claims, damages, or losses arising out of your use of the Platform, your breach of these Terms, or your violation of any law or regulation, including but not limited to claims related to alcohol service at events you host or attend.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

12. MODIFICATIONS

bartendersNow reserves the right to modify these Terms at any time. Your continued use of the Platform following any such modification constitutes your acceptance of the revised Terms.

13. TERMINATION

bartendersNow may terminate your access to the Platform at any time, with or without cause.

14. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and bartendersNow regarding the use of the Platform and supersede all prior agreements and understandings.
